1. Acceptance of these Terms

These Terms of Service ("Terms") govern your access to and use of the ShortsLaunch website at shortslaunch.com (the "Site"), the ShortsLaunch digital products including the "AI YouTube Shorts ToolKit" and any associated course materials, downloads, dashboards, prompts, templates, community access, updates and support (collectively, the "Service"), provided by ShortsLaunch ("ShortsLaunch", "we", "us", "our").

By accessing the Site, creating an account, completing checkout, or otherwise using the Service, you ("you", "customer", "user") accept and agree to be bound by these Terms, our Privacy Policy, our Refund Policy, our Disclaimer, and any other policies referenced herein.

2. Eligibility

You must be at least 18 years old (or the age of majority in your jurisdiction, whichever is greater) and legally able to enter into a binding contract to purchase or use the Service. By using the Service, you represent and warrant that you meet these requirements and that all information you provide is true, accurate, current, and complete.

The Service is offered worldwide. However, you are responsible for ensuring that your use of the Service complies with all laws applicable to you in your jurisdiction. We reserve the right to refuse service to anyone, at any time, for any lawful reason.

3. Your account

Access to the member area requires an account. You agree to: (a) provide accurate and complete information; (b) keep your login credentials confidential; (c) be solely responsible for all activity that occurs under your account; and (d) notify us immediately of any unauthorised access. We are not liable for any loss arising from your failure to safeguard your account.

Each licence is for a single individual. Sharing logins or distributing your access is a material breach of these Terms and may result in immediate termination without refund.

4. The product and licence

The Service consists of digital educational and informational content, including but not limited to pre-recorded video lessons, written guides, prompts, templates, Notion dashboards, checklists, and supplementary downloads. The Service is delivered electronically — no physical items are shipped.

Subject to your compliance with these Terms and payment of all applicable fees, ShortsLaunch grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable licence to access and use the Service for your own personal or internal business use.

You may not: (a) resell, sublicense, distribute, publicly display, or otherwise share the Service or any part of it; (b) reproduce, copy, modify, or create derivative works from the Service; (c) use the Service to develop a competing product; (d) reverse engineer or extract source content; or (e) remove any copyright, trademark, or proprietary notices.

5. Pricing, payment & billing

Currency. All prices are listed in United States Dollars (USD) unless explicitly stated otherwise. Your bank or card issuer may apply currency conversion or international transaction fees, for which you are responsible.

One-time purchase. The ShortsLaunch ToolKit is sold as a one-time purchase. There are no recurring charges. You will not be re-billed.

Payment processor. All payments are processed by Stripe, Inc., a third-party payment provider. By submitting payment, you also agree to Stripe's Terms of Service. ShortsLaunch does not store your full payment card details. We receive only the limited transaction information necessary to deliver the product and provide customer support.

Taxes. Prices displayed may not include applicable sales tax, VAT, GST, or other local taxes, which may be added at checkout depending on your billing location. You are responsible for any taxes, duties, or fees imposed by your jurisdiction.

Order confirmation. Upon successful payment, you will receive an email confirmation and access credentials. If you do not receive your confirmation within one hour, please check your spam folder or contact support@shortslaunch.com.

Chargebacks. If you initiate a chargeback with your card issuer instead of contacting us first, we reserve the right to revoke your access to the Service and pursue recovery of the disputed amount and any associated fees. Please contact us — we resolve almost every issue with a simple email.

6. Refunds

We offer a 30-day money-back guarantee on the ShortsLaunch ToolKit. If you are not satisfied for any reason, contact us within 30 days of purchase and we will issue a full refund. Full terms, exceptions, and the refund request process are set out in our Refund Policy, which is incorporated by reference into these Terms.

7. Intellectual property

All content provided through the Service — including but not limited to text, video, audio, code, images, prompts, templates, layouts, designs, trademarks, logos, and the compilation thereof — is owned by ShortsLaunch or its licensors and is protected by copyright, trademark, and other intellectual property laws. All rights not expressly granted in these Terms are reserved.

"ShortsLaunch" and the ShortsLaunch logo are trademarks of ShortsLaunch. You may not use our trademarks without our prior written consent. All other trademarks referenced on the Site (including YouTube, Google, OpenAI, Meta, TikTok, Notion, and others) are the property of their respective owners and are referenced only for identification.

8. Acceptable use

You agree not to use the Service:

• In any way that violates any applicable law or regulation;
• To create, distribute or promote content that is unlawful, defamatory, harassing, hateful, deceptive, sexually explicit involving minors, or that infringes any third-party rights;
• To distribute malware, spam, phishing material, or to attempt unauthorised access to any system;
• To impersonate any person or entity or misrepresent your affiliation with any person or entity;
• To circumvent any access restrictions or share your account credentials;
• To engage in any activity that violates YouTube's, Google's, or any other third-party platform's terms of service.

We reserve the right to suspend or terminate access for any violation, without refund where the violation is material.

9. Third-party services

The Service may reference, recommend, or integrate with third-party tools and platforms (for example, OpenAI ChatGPT, ElevenLabs, CapCut, Notion, YouTube, Stripe). We are not responsible for the availability, content, performance, terms, pricing, or privacy practices of any third-party service. Your use of any third-party service is governed solely by the terms and policies of that service.

10. Disclaimers & no guarantees

The Service is provided "as is" and "as available," without warranty of any kind, whether express, implied, statutory or otherwise, including without limitation any implied warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, or quiet enjoyment.

No earnings or results guarantee. ShortsLaunch is an educational product. We make no representations, warranties, or guarantees that you will achieve any specific result — including but not limited to views, subscribers, followers, audience growth, advertising revenue, monetisation, or income — by using the Service. Outcomes depend on many factors outside our control, including your effort, skill, niche, market conditions and the policies of third-party platforms. See our Disclaimer for full details.

To the maximum extent permitted by law, we do not warrant that the Service will be uninterrupted, error-free, secure, or free of viruses or other harmful components.

11. Limitation of liability

To the maximum extent permitted by applicable law, in no event shall ShortsLaunch, its affiliates, officers, directors, employees, agents or licensors be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including without limitation damages for lost profits, lost revenue, lost data, loss of goodwill, business interruption, or other intangible losses, arising out of or relating to your use of, or inability to use, the Service — whether based on warranty, contract, tort (including negligence) or any other legal theory, and whether or not we have been informed of the possibility of such damage.

To the maximum extent permitted by law, our total aggregate liability to you for all claims arising out of or relating to these Terms or the Service shall not exceed the amount you actually paid to us for the Service in the twelve (12) months preceding the event giving rise to liability, or USD $100, whichever is greater.

Some jurisdictions do not allow the exclusion of certain warranties or the limitation of certain damages. To the extent such exclusions or limitations are not permitted, our liability shall be limited to the smallest extent permitted by law.

12. Indemnification

You agree to indemnify, defend, and hold harmless ShortsLaunch and its affiliates, officers, directors, employees, agents, and licensors from and against any and all claims, liabilities, damages, losses, costs and expenses (including reasonable attorneys' fees) arising out of or in any way connected with: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any third-party right, including any intellectual property, privacy, or publicity right; or (d) any content you create, publish, or distribute using the Service.

13. Termination

We may suspend or terminate your access to the Service at any time, with or without notice, if you breach these Terms or if we reasonably believe your conduct may harm us, other users, or any third party. Upon termination, your licence to use the Service ends immediately. Sections that by their nature should survive termination — including those relating to intellectual property, disclaimers, limitations of liability, indemnification, and governing law — will survive.

You may stop using the Service at any time. Voluntary cessation of use does not entitle you to a refund except as provided in our Refund Policy.

14. Changes to these Terms

We may update these Terms from time to time. The "Last Updated" date at the top of this page reflects the latest version. Material changes will be communicated by posting the updated Terms on the Site or, where appropriate, by email. Your continued use of the Service after changes take effect constitutes your acceptance of the revised Terms.

15. Governing law & disputes

These Terms are governed by the laws of your jurisdiction, without regard to its conflict-of-laws principles. Subject to any non-waivable consumer rights you may have, any dispute arising out of or relating to these Terms or the Service shall be submitted to the exclusive jurisdiction of the courts located in the competent courts of the seller's registered jurisdiction.

If you are a consumer resident in the European Union, the United Kingdom, or another jurisdiction that grants you non-waivable rights, those rights apply notwithstanding the foregoing. You may also have the right to bring proceedings in the courts of your country of residence.

Nothing in these Terms limits your statutory rights as a consumer.
